Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Wheely ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of the Service

Wheely is a decision-making and entertainment app that provides customizable spin wheels, coin flips, dice rolls, lucky numbers, elimination games, time challenges, and similar randomization tools.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with these Terms and Apple's App Store Terms of Service.

4. Wheely Pro Subscription

The App offers an optional auto-renewing subscription called Wheely Pro:

• Title: Wheely Pro Membership.
• Length & price: 1 week, $9.99 per week, automatically renewing. The price shown in the App is localized to your region and currency by the App Store and always takes precedence over the figure quoted here.
• Free trial: An introductory free trial may be offered to eligible new subscribers. When a trial is available, its length and the price that applies afterwards are shown on the subscription screen and in Apple's confirmation sheet before you confirm the purchase. Any unused portion of a free trial is forfeited if you purchase the subscription before the trial ends.
• Billing: Payment is charged to your Apple ID account at confirmation of purchase, or at the end of the free trial if it is not canceled beforehand.
• Auto-renewal: The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: You can manage or cancel your subscription at any time in your device's Settings → Apple ID → Subscriptions. Canceling stops future charges; you keep Pro access until the end of the paid period.
• Refunds: Purchases are processed by Apple. Refund requests are handled by Apple under its policies at reportaproblem.apple.com.

Prices may change in the future. If they do, the new price will only apply to subsequent billing periods, and Apple will notify you in advance as required.

5. Free Tier & Feature Limits

The free version of the App lets you spin the preset wheels and templates, view your spin history, and use the basic tools. Creating or editing your own wheels, premium wheel styles, Time Challenge mode, and the full Elimination mode require a Wheely Pro subscription. We may adjust what is included in the free tier and in Pro over time; active subscribers will not lose access to features materially central to Pro during a paid period.

6. Your Content

Wheels, options, and other content you create in the App are yours and are stored only on your device. You are responsible for the content you create and share. You agree not to use the App to create or share content that is unlawful, harassing, or infringes the rights of others.

7. Intellectual Property

The App, including its design, graphics, animations, sounds, and code, is owned by us and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works of the App except as permitted by law.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose, including any form of gambling or wagering with real-world stakes;
• Attempt to circumvent purchase verification or feature limits;
• Interfere with or disrupt the operation of the App.

9. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of or related to your use of the App. Our total aggregate liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including any non-waivable statutory rights you hold as a consumer.

11. Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your access to the App if you materially breach these Terms. Sections 6–10 and 14 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted at this page with a new effective date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict-of-law principles, except where the mandatory consumer-protection laws of your country of residence apply.

14. Apple-Required Terms

Because Wheely is distributed through the Apple App Store, the following terms apply and, in the event of any conflict, take precedence over the rest of these Terms:

• Acknowledgement: These Terms are concluded between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
• Scope of licence: The licence granted in Section 3 is limited to a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
• Maintenance and support: We are solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services.
• Warranty: We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
• Product claims: We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
• Intellectual property claims: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
• Legal compliance: You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms: You must comply with applicable third-party terms of agreement when using the App.
• Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
